- July 2007 Tropicana Settles Deadly 2003 Garage Collapse for a record $101 Million, the largest construction accident settlement ever.
Michael Maggiano and Christopher DiGirolamo were Co-Lead Counsel for the 4 men killed and 36 other men injured in the horrible garage collapse at the Tropicana in 2003, were instrumental in delivering a record settlement for the families of the four workers killed when a parking garage under construction collapsed at the Tropicana Hotel and Casino in Atlantic City will share a settlement package of $101 million with 36 other men who were injured in the collapse. The settlement included approximately $82.5 million in cash, $2 million in previously settled cases, approximately $8.2 million of workers compensation payments to victims that will not have to be repaid, and more than $8.3 million in future medical expense.
The payout is believed to be the largest settlement of a construction accident case in U.S. history.
Trial preparation by plaintiff attorneys included taking nearly 250 depositions, including those of leading structural engineering experts, obtaining and examining more than 1.5 million pages of documents, and more than 50,000 pages of depositions transcripts.
Michael and Chris, in addition to being nominated by their peers as Co-lead trial counsel for the entire group, represented three men individually who all suffered permanently disabling injuries. They achieved an award of $3.75 million for a fifty year old cement finisher who suffered multiple shoulder fractures, permanent neck and low back injuries required surgical repair of his low back, as well as post traumatic stress and anxiety as a result of the collapse.
They also obtained an award of $2.65 million for a thirty-seven year old cement finisher foreman who sustained closed head brain injury and has not been able to return to any form of employment.
Maggiano and DiGirolamo successfully obtained $2.65 million dollar award for a thirty-three year old cement finisher who suffered two herniated discs in his low back which required fusion surgery, as well as psychological trauma and anxiety. These injuries still prevent him from being able to maintain any form of employment.
In addition, Maggiano and DiGirolamo were able to negotiate for their 3 clients a complete waiver of their workers compensation liens, which were each over $250,000.00, and guaranteed each man would receive accident related medical treatment for life.
