What Constitutes Nursing Home Abuse?

Nursing home abuse can include a range of harmful actions taken against nursing home residents. While this can include violence and physical assaults, physical contact is not necessary for nursing home abuse to occur. Neither is intent. This means that, regardless of whether the abuser makes physical contact with a resident or intended to harm the resident, nursing home abuse can still happen.

The most common forms of nursing home abuse include:

  • Physical or sexual abuse
  • Psychological abuse
  • Financial abuse
  • Neglect.

Some examples of nursing home neglect that may constitute abuse can include (but may not be limited to) failures to:

  • Monitor residents
  • Assist in feeding or bathing residents
  • Provide necessary medical care, like administering medications or treating obvious health problems (like bedsores or broken bones).

Who Is Liable for Nursing Home Abuse?

The person committing the abusive act will be at least one of the parties liable for the harm, suffering and losses (s)he causes. These abusers can include (but may not be limited to):

  • Nursing home staff
  • Other nursing home residents
  • Visitors to the nursing home.

In addition to the perpetrator of nursing home abuse, others who may be liable can include (but may not be exclusive to):

  • Nursing home staff – Even if nursing home staff members are not the perpetrators of abuse, they can still be accountable for abusive acts when their negligence contributes to the abuse. For example, staff’s failures to monitor residents can be a form of negligence that allows abuse to occur.
  • The companies that own and operate nursing homes – The actions and policies of these companies may also give rise to abuse against nursing home residents. For example, when these companies fail to hire enough staff, fail to properly vet staff or fail to ensure homes have the proper security polices or systems in place, these forms of negligence can all play a role in allowing abuses against residents.

How Do I Report Nursing Home Abuse?

If you have been the target of any form of nursing home abuse – or if you suspect a loved one has been the victim of such abuse, you can take action to report the abuse by contacting the:

  • Hackensack Police Department – If the abuse puts you or a loved one in imminent danger, contact police immediately.
  • New Jersey Department of Health (DOH) – The DOH accepts complaints against nursing homes and long-term care facilities seven days a week. These complaints can be filed online or by calling the DOH complaint hotline at (800)792-9770.
