Occasionally, people sustain bodily injuries as a result of eating contaminated food at a restaurant.
An example of such a case is when someone bites into their food only to discover that there is a foreign object hidden in the dish. People can become very ill with food poisoning as a result of negligently prepared food. Biting down on something hard can also cause dental problems.
ABC News reported that a New York woman says she found a lizard arm and head in her salad that she had delivered from a local restaurant.
According to reports, the woman had already eaten part of the salad before making the discovery in her bowl. The woman immediately called the restaurant to report her findings; she wanted a refund and refused their offer to replace the salad.
She reported, “I’d taken like 15 bites, and I sort of turned it over. I could see the scales and the little lines of the mouth, and the arm hanging off.”
Foreign objects can make it into your food in a number of ways:
- Cleaning residue may be left in dishes and glasses if dishwasher did not complete a thorough rinsing
- Can be inserted in the food during the manufacturing process
- A worker may intentionally place an inappropriate item in food if he or she is disgruntled
However, most of these cases rest on the theory of negligence. A restaurant is expected to act in a reasonable manner during the manufacturing, distribution and servicing process. Restaurants must also comply with health and food laws.
When a restaurant breaches its duty to the public, it can be held liable for damages that are directly related to its negligence.
The restaurant is investigating the matter.
