Vehicle Safety Recall Notice

On April 18, the U.S. Department of Transportation (DOT) National Highway Traffic Safety Administration (NHTSA) released information that particular vehicles may be part of a current safety recall that could pose risks to drivers and passengers alike. If these defects do not get instant repairs, they could lead to injury or even death.

What is a recall? Recalls are issued by NHTSA when a determination is made that a vehicle creates an unreasonable safety risk or doesn’t meet the safety standards necessary. Safety defects are defined as problems that exist in a vehicle due to defective equipment, and pose a risk to motor vehicle safety overall. They may actually exist in a group of vehicles with the same design or manufacture, or items of equipment that have the same type of manufacture. So, what this means to you as the consumer, is that a defect has been identified that will affect your day-to-day life driving your particular vehicle model.

What happens if my car is part of a recall? If you have received a letter in the mail signifying a recall, you should always contact your local dealership for a remedy. Your vehicle will be serviced for free according to the recall.

In the Event That You Were Injured

If you were injured in an accident involving a defective vehicle that was recalled, you may have to file a lawsuit in a product liability case. You would bring this suit against the manufacturer and make a claim that the car was defective when you first purchased the vehicle and that you suffered damages as a result of the defect in the vehicle. You will not have to show that the manufacturer acted carelessly or made an error when producing the car. In the event of a crash, a vehicle holds the duty of having to protect you in some way. If you have a vehicle affected by a recall and you were injured, you may have a case. Call Maggiano, DiGirolamo & Lizzi today to find out more.
